Frequently Asked Questions

The Permitting & Inspections hours are Monday through Friday, 8:00 a.m. to 5:00 p.m.

To change contacts on any associated permit(s), you must upload a completed Permit & Plan Revision Form to your permit. An administrative fee will be applied to the associated permit(s).

Any contracted work which exceeds $40,000 per project (Reference NCGS § 87-1).

A homeowner can act as the general contractor on their own house, after meeting the requirements and filling out a Homeowner’s Affidavit. A permit is still required, and code compliance shall be the responsibility of the homeowner.

Anytime Mechanical, Electrical, Plumbing, or Fire Protection work is performed, a license is required. A homeowner may be able to meet license exemption requirements on their own house, but a permit is still required, and code compliance shall be the responsibility of the homeowner.

An address assignment is required for all One and Two-family Dwellings and all new Commercial accessory structures, buildings, and units (Including but not limited to: retaining walls, amenities, dividing of existing units, detached meter pedestals, etc.)

To apply for an address request, visit and login to the Town of Leland’s Online Services for Planning and Zoning Projects. Click on “Create Project” and select project category “Zoning” and project type “Address Request.”

Permits may not be required for any projects with work costing $40,000 or less, unless the work involves:

· The addition, repair, or replacement of load bearing structures

· The addition or change in the design of a plumbing system

· The addition, replacement or change in the design of a heating or air condition system

· The addition, replacement or change in the design of an electrical system

· The use of materials not permitted by the code

· The addition of roofing, excluding replacement of like grade fire resistance materials

• There are certain exemptions for a like kind replacement of the same size, location, capacity, fuel source as the previous water heater or other plumbing fixture (does not include fuel gas appliances) if the work is completed by properly licensed contractors. Code compliance still must be met and is the responsibility of the licensed contractor. A homeowner replacing their water heater or plumbing fixture does not meet this exemption.

A permit expires six months after the date of issuance if the work has not commenced. If after commencement, the work is discontinued for a period of 12 months, the permit immediately expires.

A residential accessory structure that does not exceed 12-feet in any dimension can be constructed without a building permit. A zoning permit is still required to ensure zoning code requirements. Permits will be required for any trade work (electrical, plumbing, etc.)

The following accessory structures shall meet the provisions of the building code: decks, gazebos, retaining walls, detached masonry chimneys, swimming pools and spas, detached carports, and docks, pier, bulkheads, and waterway structures.

Commercial wood, vinyl, or chain-link fences six feet in height or less, do not require a building permit. Both residential and commercial masonry walls must be submitted to the Permitting & Inspection department to determine if a building permit is required.

Refer to the Town of Leland zoning ordinance for zoning approval requirements related to fences. It is recommended that property owners communicate with their neighbor(s) regarding the proposed height and location of the fence to ensure the verification of the property line. (Proposed pool barriers shall be permitted and inspected under the swimming pool permit. Any alterations to the swimming pool barrier shall meet AV 105 NC Residential Building Code.)

Yes, a residential sunroom permit is required with the Town of Leland. An application, site plan, and engineered plan are required to be submitted through the Town of Leland online permitting system if it cannot be constructed prescriptively.

A Residential Alteration permit is required to convert an unheated sunroom into a heated sunroom. If you intend to install a mechanical unit or insulation, the Residential Alteration permit will cover any applicable inspections.

· Inground Swimming Pool over 24 inches (610 mm) deep

· Inground Spa

· Above ground Spas/Hot Tubs

A trade permit is required for the installation of a new appliance that involves new electrical, gas, plumbing or mechanical.

Currently, the Town of Leland Permitting and Inspections department does not provide plan review expedited services.

Residential

· 1st submittal – 10 business days

Commercial

· 1st submittal – 10 business days

· 2nd submittal – 5 business days

· 3rd submittal – 5 business days

A design professional’s seal and signature are generally required, on plans for all commercial construction projects (NC General Statute 83A-13(c) 1-6). This requirement is subject to the exceptions listed in NC General Statute 83A-13(c1). A code official may exercise judgment to require seals where necessary to protect the public.

A homeowner, licensed contractor, or an authorized representative of age 18 years and older shall be present if access must be provided.

If you are unable to schedule an inspection, it may vary depending on the following situations:

· Outstanding permit fees or reinspection fees

· Permit is not issued

· Permit may be expired

· Requested to schedule an inspection after the 3:00 p.m. daily cut off time

· Daily inspection limit has been met for inspection request date

· Permit has a hold on inspections

Request to cancel inspection must be sent via email to inspections@townofleland.com or call our general office at (910) 371-3754. To avoid a same day cancellation fee, please cancel the inspection prior to the inspection date. Please refer to the fee schedule for same day cancellation fee.

Live remote inspections are only performed for residential mechanical change outs including mini split change outs and sunrooms (excluding addition sunroom framing inspections). We cannot inspect a fuel gas appliance through a live remote inspection. You can substitute a live remote inspection with an in-person inspection upon request.

Submit a Change of Occupancy, without alterations, application to the Permitting & Inspections department. Fire Final, Zoning Final and Building Final inspections will be required to determine compliance with technical codes for the occupancy intended. Once verified for compliance, a certificate of occupancy shall be issued.

A certificate of occupancy will be issued upon satisfactory completion of the building and after all final inspections are approved.

A temporary/partial certificate of occupancy may be issued for a state period once the inspector finds safe for occupancy prior to final completion.

At the conclusion of all work done under the building permit, the appropriate inspector shall make a final inspection, and, if the inspector finds that the completed work complies with all applicable state and local laws with the terms of the permit, the inspector shall issue a certificate of compliance. The Town of Leland inspections department is responsible for conducting Level I-III fire inspections.

Fire construction and operation permits must be submitted through the Town of Leland’s Online Service for Permitting and Inspection.
